Rules and Regulations

The Board of Governors, in an effort to make our park safe and enjoyable for all, unanimously approved the following rules and regulations. They are incorporated as part of your membership agreement with Cushing Memorial Park (hereinafter referred to as “the Park”) and written in accordance with county laws and the U.S. Army Corps of Engineers (USACE) Title 36 Code of Federal Regulations. The Board of Governors will be responsible for tracking compliance among Park attendees.  

 

Violation of rules and regulations by any member, family or guest of a member may result in the termination of membership.

  1. The Park will not be responsible for fire, theft, storm damage or any other damage or loss to any member’s personal property.
  2. The Park speed limit is 10 mph. This speed applies to all vehicles including golf carts, mule type carts and motorized bikes.
  3. Skateboarding and razor type scooters are not permitted in any area of the Park.
  4. A valid state driver’s license is required to operate motorized vehicles including golf carts, electric scooters and mini bikes in the Park.
    1. Go-carts and multi-wheeled all terrain vehicles (ATVs) are prohibited.
    2. All vehicles except golf carts & mule type carts must be street legal and operated on Park roads. Off-roading is prohibited in the Park.
    3. Motorized bikes must be street legal with stock mufflers and all standard safety equipment.
    4. A fine of $25 may be issued to those operating a motorized vehicle (including golf carts) without a valid state driver’s license.
  5. All posted signs should be obeyed. Members are responsible for holding each other accountable in a respectable manner and reminding others to obey posted signs.
  6. Swimming at boat launching ramps is prohibited. Swimming is only allowed at the END of docks 6 & 7.
  7. Radios, TVs and other general noise are to be lowered to a level that is not disturbing to others at 10:00 p.m.
  8. Profanity and drunken behavior is not permitted. Disorderly conduct could result in a ban up to two years from the Park on the first offense.
  9. Underage drinking is not permitted in the Park and parents/members will be held responsible for actions of their children.
    1. If the first offense occurs with a dependent child and the parent is not present in the Park and the incident cannot be resolved within the Park, local authorities will be contacted and the parent will be notified. The offense will be documented with the Board of Governors. Upon the second offense, the membership will be canceled and gate cards deactivated. The member will be given 30 days to remove their personal property from the Park. The member will be instructed by letter to contact the Park office to gain access into the Park in order to obtain their personal belongings.
    2. In addition, if the member owns a trailer, the member will have until the end of their lease agreement to sell said trailer.
    3. If the offense occurs with a guest of a Park member and cannot be resolved within the Park, local authorities will be contacted. The member will receive a letter documenting the offense and the guest will be banned from the Park.
  10. Alcohol is not permitted to be consumed on the docks, in the clubhouse, the swimming pool area or other public areas.
    1. Members and/or guests who give the appearance of intoxication will be asked respectfully to return to their boat house/trailer/campsite/cabin.
    2. If the member/guest refuses to return to their boat house/trailer/campsite/cabin local authorities may be contacted and a warning letter will be issued to the member on the first offense. Park membership will be terminated upon the second offense. A Board member should be notified in these instances and document the information for the member’s file.
  11. Possession, distribution or the use of illegal substances is not tolerated in the Park.
    1. There is a no tolerance policy for possession of illegal substances. Local authorities will be contacted, membership canceled and gate cards deactivated.
    2. The member will be given 30 days to remove their personal property from the Park. The member will be instructed by letter to contact the Park office to gain access into the Park in order to obtain their personal belongings.
    3. In addition, if the member owns a trailer, the member will have until the end of their lease agreement to sell said trailer.
  12. Parents are responsible for their dependent children and their activities at all times.
  13. Pets are permitted only if they are leashed and do not disturb other members. Pets shall be toileted only on grass/wooded areas. Please clean up after your pet if an accident happens. Pets are not allowed in the cabins, clubhouse, swimming pool, or eating areas of the clubhouse or pavilions.
  14. Firearms are prohibited in the Park. This includes pellet rifles, BB guns, air rifles, paintball guns, sling shots, bows & arrows or any type of device that fires projectiles. Hunting of any kind on Park property is illegal. Consequently state carry permits issued to non law enforcement officers are not valid on Corps property. USACE will be contacted if a member or guest is found to be in violation of this rule.
  15. Property cannot be altered without Cushing Memorial Park, Inc. and the USACE written approval. Those found in violation will be required to place the property back in its original configuration at their own expense.
    1. Member will be notified with a certified return receipt letter requesting property returned to its original state within 45 days of receipt of the letter.
    2. If the property is not returned to its original state within said time frame, the member’s gate cards will be deactivated.
    3. If the Park is forced to return the property back to its original state, the cost will be charged to the member to include labor and expenses.
    4. The member’s gate cards will be re-activated when payment is made for the Park’s services.
    5. If payment is not made within 30 days of services rendered, the member will be notified to remove their personal belongings immediately by contacting the Park office. The member will have until the end of their lease agreement to sell their trailer at which time membership will be canceled
  16. It is the responsibility of the lessee to maintain the leased property in habitable conditions. Repairs are to be made with proper materials that comply with Cherokee county building codes and USACE and do not affect the surrounding property.
    1. Failure to maintain the leased property up to the standards deemed appropriate by the Park and USACE will result in the Park conducting repairs/clean-up at the lessee’s expense.
    2. All boat house, trailer and campsite lessees must maintain a neat and clean appearance as deemed appropriate by the Park and USACE.
    3. All campers, travel trailers, mobile homes and appurtenant structures must be structurally sound and maintained in a safe and usable condition
  17. Dumpsters are for use of trash generated in the Park only. Hazardous materials, refrigerators, freezers or air conditioners are not to be dumped in the Park trashcans, dumpsters or left in any area of the Park.
    1. Members/guests found in violation of this rule will be fined $350 per item to cover the cost for the Park to remove said items
  18. Permission from the USACE needs to be obtained to cut down any trees in the Park.
    1. The Board and maintenance committee should be notified of any dead trees. Removal of dead trees will be the responsibility of the Park.
    2. The USACE does not permit anything to be attached to the trees in the Park.
  19. Prior to any leased property in the Park being advertised for sale, owner shall notify the Board. The Board is responsible for ensuring the new owner is a member of the Park, aware of the Rules & Regulations and provided with a lease.
  20. Occupying any lands, buildings, vessels or other facilities within the premises for the purpose of maintaining a full-time residence is prohibited except for employees residing on the premise for security and maintenance purposes as authorized by the USACE.
  21. Family members of a member must be at least 16-years-old to enter the Park unattended. The member will be held responsible for the conduct of family members and guests according to the Rules & Regulations listed.
  22. Members will be limited to 10 guests at one time, unless prior written approval is obtained from the Park President.
  23. Automobile parking in front of individual boathouses is permitted as long as other boat house lessees are not hindered.
    1. Removal of any vehicle may be towed at owner’s expense if the vehicle hinders access to other lessees’ property. The Park will assume no liability if damage, loss or theft is incurred.
  24. For the safety of everyone, all lights, fans and appliances must be turned off when leaving the Park for more than 24 hours. Members will be billed $25/day after notification.
  25. Members must meet guests at the front gate for entry and exit. Gate cards are not to be loaned to anyone.
  26. Canopies allowed only on docks 6 & 7 with the following stipulations:
    1. Cannot be left up overnight
    2. Available on a first-come first-served basis (no reserving)
    3. Do not secure to dock with screws or use dock screws
    4. Walkway MUST be available to swim ladders at all times

While in the Park area, these boating regulations must be observed by members:

  1. Boat trailers must be parked in designated boat trailer parking areas only while member remains in the park.
    1. Trailer must bear owner’s name and boat registration number.
    2. Dock slip lessees cannot park boat trailers in such areas for an extended period of time.
    3. Boat trailers in a non-designated/unassigned area will be towed at owner’s expense.
    4. Trailers must be disconnected from vehicles.
    5. Automobiles cannot park in trailer parking areas.
  2. Damage to docks due to fire, improper tying or handling of vessels will be charged to the violator or vessel owner. Vessels should be adequately moored with appropriate lines and bumpers to prevent damage to the docks and other vessels.
  3. All vessels will be operated and equipped as required by federal, state, and local boating regulations for Lake Allatoona or Department of Natural Resources will be contacted.
    1. Members not in compliance with federal, state and local boating regulations will be notified by mail requesting compliance immediately upon receipt of the letter.
    2. Members’ gate cards will be de-activated until such time member can show proof that they have applied for registration. Member will need to contact the Park office to gain entry into the Park to present boat registration information prior to gate cards being re-activated.
    3. Information on members who remain in non-compliance with no proof of having applied for registration will be forwarded to the Department of Natural Resources to manage the situation further.
  4. Upon payment of lease agreement, vessels belonging to Park members may be parked in leased dock slips or in designated leased on-land storage.
  5. Vessels parked in any area of the Park or tied to a dock in the Park are parked at the owner’s risk and the Park will assume no liability for damage, loss or theft of such vessels or its contents while in the Park.
  6. All vessels must maintain idle speed in “No Wake” areas.
  7. All vessels will follow water-ski traffic patterns even though no skier is being pulled.
  8. Vessels may not enter dock areas while trailing towrope of any description.
  9. Vessels pulling skiers have right-of-way over powerboats operating in ski pattern.
  10. Inbound boats have right-of-way over powerboats operating in ski pattern.
  11. Launching ramps and day use docks 5, 6, 7 and 8 are available to all members on a first come first serve basis.
  12. Boats belonging to members may be stored in the water or in a land lease space under the following conditions:
    1. In the event it is necessary to move a vessel to another parking area, the Park as a result of the movement of the vessel will assume no liability.
    2. Members are allowed to leave their vessels in the Park if the member pays for a space at a leased dock or land space.
    3. Members who are absent from the Park and leave their vessel(s) in the water at day-use dock 5, 6, 7 or 8 will be contacted and asked to remove their vessel immediately.
    4. Members who are absent from the Park and leave their vessel parked in front of their boat house will be contacted and asked to remove their vessel in order to maintain a neat and clean appearance in the Park.
    5. A $25/day fee will be incurred during a grace period determined by the Board for each day a vessel is left unattended at day-use docks 5, 6, 7 or 8. After such grace period, the Board will turn the matter of removing said vessel over to the Department of Natural Resources.
    6. Vessels stored in a land lease space are to maintain a neat and clean appearance
    7. The Park will assume no liability for loss, damage or theft of such vessels or contents stored on the dock.
  13. Except leased docks, members cannot reserve docking locations for in-water storage. Repetitious use of a parking space does not constitute further claim to that space.
